Deputy waives arraignment

CLOVIS – A Curry County Sheriff’s deputy accused of shoplifting on Sept. 9 has waived arraignment, court records show.

Riley Loomis, 47, was scheduled to appear in court on Friday but chose to waive his first court appearance. He is accused of failing to scan 24 items into the self-checkout register at Clovis’ Walmart. The items are valued at $126.95, court records show.

Dan Lindsey, Loomis’ attorney, said he does not know when a new court date might be set.

Judge Shaun Burns and prosecutor Brian Stover have recused themselves from the proceedings. Tim Rose, the district attorney in Tucumcari, has been assigned as a special prosecutor in the case, but no judge had been appointed to the case early this week.

Loomis was placed on restricted administrative duties soon after he was charged, Curry County Undersheriff Michael Brockett said.

Loomis has requested a jury trial, according to court documents filed Sept. 16. He did not respond to a Facebook message from The News.
