A Cannon captain serving as a physician's assistant will face a court martial in February on charges of child molestation , according to the 9th Judicial District Attorney Matt Chandler.

Capt. Robert Bitner was arrested by Curry County Sheriff’s deputies in June on four counts of criminal sexual contact of a child under 13, Chandler said.

Chandler said the military requested jurisdiction from his office, which he approved. The case in district court is not closed, however, and his office will continue to watch the federal case, he said.

“We are closely watching the federal case. Our goal is that the (victim’s) family receive justice. If they receive that through the federal trial we will reevaluate (our case),” Chandler said.

Bitner engaged an 8-year-old boy in sexual activity on multiple occasions while the child was a guest in Bitner's home, according to a criminal complaint filed in Curry County Magistrate Court contained

Neither Bitner nor his civilian or military attornies returned calls seeking comment.

A court martial is scheduled Feb. 6 at Cannon, according to Cannon officials.
