CLOVIS - A second brother has been convicted of aggravated battery in connection with a 2018 attack, District Attorney Andrea Reeb announced in a news release.
Clovis' Matthew Armendariz, 27, was found guilty Wednesday by a Curry County jury of aggravated burglary and aggravated battery, both felonies.
Armendariz' brother, Eleazar Armendariz, was convicted in September for the same incident and sentenced to 18 months in prison.
According to the DA's news release:
On Dec. 2, 2018, Armendariz and his brother entered their mother's home without permission and attacked Manuel Hernandez-Carrillo while he was asleep in bed. Their mother was also injured while attempting to stop the attack. This attack led to Hernandez-Carrillo having broken ribs, contusions, bruises, and a perforated lung. The brothers then fled the scene. Armendariz was arrested a few days later by the Clovis Police Department.
Judge Drew Tatum found that the court could better determine a sentence by ordering Matthew Armendariz to a 60-day diagnostic evaluation. He faces a maximum sentence of 12 years in prison, according to the release. He remains in custody pending sentencing.
