Judge orders teen shooting suspect held

Prosecutors said a district judge Tuesday ordered a 13-year-old charged with murder to remain in custody throughout the prosecution of his case.

D’Angelo Montoya has been held at the Curry County Juvenile Detention Center since July 24.

He is charged with first-degree murder in the July 22 shooting death of 22-year-old Angel Vale, an Eastern New Mexico University student.

At a hearing Tuesday, prosecutors said they told Judge Drew Tatum that Montoya is a serious danger to the community and himself.

“It is imperative to keep in mind that this juvenile is deemed innocent until proven otherwise. Saying that, we will pursue this case diligently with the ultimate goal of serving justice to all parties involved,” Chandler said in a press release.

Tatum also ordered Montoya undergo a competency evaluation, Chandler said.

Chandler said Montoya cannot by state law be charged as an adult.

If Montoya is found guilty in the case, he faces a maximum penalty of commitment with the Children Youth and Families Department until age 21.
