Police: No charges planned in fatal collision

State Police Public Information Officer Lt. Eric Garcia said Thursday that police are not planning to file charges in Tuesday’s fatal wreck on N.M. 267.

Joseph R. Ulibarri, 46, of Portales, was killed in the accident. Ulibarri wasn’t wearing a helmet and was near the center of the road in an unlit area when he was hit, according to an e-mail from Garcia earlier in the week.

The case has been sent to the District Attorney’s office for review to make sure everything is in order, Garcia said, but he doesn’t expect any changes in plans.
