Daycare owners to be tried together

PORTALES - Daycare operators accused of child abuse resulting in death and great bodily harm will be tried in court together, attorneys have agreed.

Mary Taylor, 62, and her daughter, Sandi Taylor, 31, were arrested July 25 after Maliyah Jones, 22 months, and Aubriauna Loya, now 2, were left in a vehicle outside the Taylors' daycare for approximately 90 minutes.

Maliyah was pronounced dead on arrival at Roosevelt General Hospital. Aubriauna was transported to a Lubbock hospital in critical condition, and has since been released.

In a pre-trial conference on Thursday, the Taylors' attorney, Tye Harmon, said he had come to an agreement with 9th Judicial District Attorney Andrea Reeb to vacate both of his clients' previous trial settings in favor of one trial.

The new trial is scheduled to take place Sept. 24-28, and will require two jury panels, according to Judge Donna Mowrer.

"We have come to an agreement, a joinder. I have met with my clients. They understand that they could object to the joinder. However, after lengthy conversations, both Sandi and Mary Taylor have elected to have those cases heard together," Harmon said.

Reeb said she agreed to the joinder, but made certain that Harmon had "gone over with them the fact that certain statements have been made by different parties that may not be admissible had they been tried separately."

Harmon confirmed he had made his clients aware of the "consequences, both good and bad," of the joinder.

Mowrer said pre-trial conferences "to discuss the readiness of the case for trial" would be scheduled for March 6 and July 18.

I think this case should be best handled by the affected families by a plea deal with DA!!! Nothing can ever compensate the victims yet it was a very unfortunate accident yet the long term welfare of the survivors must be the utmost importance!!! May God Bless everyone involved!!!
