6/26 Court Dispositions

The following criminal dispositions were filed in 9th Judicial District Court:

• Kenneth R. Bair, 46, pleaded guilty to DWI (fifth offense) and is ordered to serve one year imprisonment by Department of Corrections followed by one year supervised probation, pay $5 for the domestic violence offender treatment fee, submit a DNA sample and pay a $100 testing fee. Upon release from the Department of Corrections an ignition interlock device will be installed on Bair’s vehicle for one year. Bair will receive credit for two days pre-sentence confinement.

• Amie R. Kelly, 25, entered an Alford* plea to forgery and is ordered to serve three years supervised probation, pay $5 for the domestic violence offender treatment fee, submit a DNA sample and pay a $100 testing fee.

• James G. Dominguez, 36, was found guilty by the court of driving while under the influence of intoxicating liquor or drugs and is ordered to serve seven days imprisonment in the Curry County Adult Detention Center followed by one year supervised probation, complete 48 hours community service, attend a MADD victim’s impact panel, pay all probation costs and fees.

• Theresa A. McCard, 39, pleaded guilty to possession of a controlled substance (methamphetamine, two counts), possession of drug paraphernalia (two counts), concealing identity and is ordered to serve 11 months supervised probation, complete a substance abuse screening and comply with the recommendations of the screening, pay all probation costs and fees, submit a DNA sample and pay a $100 testing fee.

• Rickey Ray Hall, 35, pleaded guilty to trafficking controlled substances (distribution, two counts), and is ordered to serve two years imprisonment, followed by five years supervised probation, complete a substance abuse screening and comply with the recommendations of the screening, pay all probation costs and fees, submit a DNA sample and pay a $100 testing fee.

• Marie Apodaca, 33, pleaded guilty to forgery (making or altering, three counts), fraud ($100 or less, two counts) and is ordered to serve three years supervised probation, pay $5 for the domestic violence offender treatment fee, pay all probation costs and fees, submit a DNA sample and pay a $100 testing fee.

• Andrew Mike Martinez, 32, pleaded guilty to conspiracy to commit distribution of a controlled substances (methamphetamine), and is ordered serve 18 months supervised probation, complete a substance abuse screening and comply with the recommendations of the screening, pay all probation costs and fees, submit a DNA sample and pay a $100 testing fee.

• Willie D. Osby, 36, pleaded guilty to trafficking a controlled substance (cocaine), and is ordered serve five years supervised probation, pay a $75 chemical analysis fee, pay all probation costs, submit a DNA sample and pay a $100 testing fee.

• Raymond Sanchez, 37, pleaded guilty to driving while under the influence of liquor or drugs (second offense), driving while license suspended or revoked and is ordered serve one year less five days supervised probation, complete a substance abuse screening and comply with the recommendations of the screening, pay a fine of $500, pay all probation costs and fees.

• Liea Schmidt, 40, pleaded guilty to assault upon a peace officer (two counts) and is ordered serve 364 days supervised probation, complete anger management, be screened for alcohol abuse and pay $5 for the domestic violence offender treatment fee.

• Charles L. Banister, 23, pleaded guilty to trafficking controlled substances (manufacturing, methamphetamine), possession of a controlled substance, possession of drug paraphernalia and is ordered serve three years imprisoned by the Department of Corrections followed by five years supervised probation, pay a $75 lab fee, pay all probation costs and fees, submit a DNA sample and pay a $100 testing fee.

• Anastacio A. Esquibel, 23, pleaded guilty to criminal sexual penetration (child under 13, two counts), criminal sexual contact of a minor (child under 13, three counts) and is ordered to serve 20 years imprisoned by the Department of Corrections followed by a period of five to 20 years supervised parole. Esquibel is further required to register as a sex offender under the rules of the Sex Offender Registration and Notification Act, receive sex offender treatment, pay all fines and fees, submit a DNA sample and pay a $100 testing fee. Credit will be given for 638 days pre-sentence confinement.

* The “Alford plea” is a plea made by defendants wherein they do not admit guilt, however they concede the evidence against them is substantial enough to result in a conviction.
